A curious case, in which the complainant, with the greatbst effrontery, admitted having had criminal intercourse with the defendant's wife, came before the Melbourne District Court. Michael Kinane, a young man . following the business of a blacksmith, summoned Sergeant Summerhayee, a well-known member of the Melbourne Police Force, for assault ; but : admitted that he . had acted as above stated ». ■• - He was caught in the house with Su mmerhay es's wife at midnight, when Summerhayes came in and assaulted him. He expressed his belief that the Sergeant knew of his wife's conduct. The Bench said that the man had shown base assurance in going back to the place and repeating his conduct after being thrashed, instead of praying fervently; that he was not killed. The case was dismissed, with L 3 33 costs, or a month's imprisonment.
