WARDEN'S COURT, AHAURA.
Thursday, January 18. (Before Mr Warden Whitefoord.) J. F. Johnstone v. Catherine Bergin. — A complaint that the defendant was in illegal possession of a building site at Antonio's Flat, Little Grey.: The defendant's husband (who is not at present living in the district) was an hotel-keeper at Antonio's Flat, and he rented the site on which the house stood from the complainant for the last two and a-half years, at the nominal rental of 5s per week. In consequence of a disagreement between the parties, the complainant gave the defendant notice to quit ;. and this being disregarded, he took possession on the 25th November last ; but the defendant refused to leave, and still held possession. The present action was to evict her. for the defence, it was contended that the Court had no jurisdiction to entertain an action against a married woman, her husband being living, and also that the notice to quit was insufficient. The complainant's right to the site was not denied. The Warden overruled the first objection. Any person, being- the legal occupier of Crown lands on. the gold fields, : could be proceeded against under the Gold Fields Act, which . did not recognise social or matrimonial distinctions. With regard ; to the second point, he considered the defendant had received ample notice to give up possession, and that she liad not been treated, by any, means in the harsh manner complained of The defendant would have to give up possession within seven days, and pay the costs of the action. v .
