WARDEN'S COURT.

CAMPTOWN. Wednesday, 17th August,

(Before Mr Warden Whitef oord. ) James WyKe applied for. permission to cut a surface drainage race at Maori Gully, No. 2, No -Town district. Opposed by Thomas Walsh on the ground that the application, if granted, would deprive him j of the- water he was entitled to under his registered right. He had also applied for permission- to utilise the surface drainage applied for by Wylie. A witness named George Mehegan was called in support ofthe application, and he said the objectors (Walsh and his party) wanted the- whole country to themselves because they were " old identities." He. (witness) waV of opinion that it was time such foolish notions were done away with; in fact, Walsh's party had enjoyed undisturbed possession of the water so long that "they thought it rained for their especial benefit." .Thomas Walsh appeared for his party, and produced a registration certificate in the creek for. two ; heads' of water. It was dated prior to the applicant coming into the gully. The Warden held that the certificate produced did not include the right asked for. Wylie's application would be granted, provided he allowed his tail-water, to flow so as the claims below could utilise it. Walsh's application would be refused, and hewould advise all the parties instead of wasting time going to law, to set to work to repair and enlarge the dam which was already in tho creek, and then they would always/have a supply of water. . Baker and party, applied, for leave to cut flood and ! tail race£ at the left-hand branch of No Town Creek. The application was. objected to by J. W. Lane on the ground that the tail-race applied for would carry the head water past the claim. Application refused. James M'Fee applied for a registered, certificate for a head-race at the Deep Lead, Nelspn Creek. Opposed by Patrick Murtagh, on the ground that the right to this water was granted to him on March 14th. In answer to the Warden the objector acknowledged that he had done no work at the race siDce.he obtained the certificate. . Application granted, the objector, -to pay costs, and LI expenses of one witness. The Court adjourned to August 31..
