CAMPTOWN.
Wednesday, 3rd August. (Before Warden Whitefoord.) An application was filed by George M'Logan for a water right at Maori Gully No. 2, No Town district. The applicant did not appear, and the Warden's Clerk explained that M'Logan had been in attendance at the Court and other places "too much" during the morning ; he had become unwell, and he had beeii locked up until he got better. The ap.plication was opposed in person by John Askam, on the ground that it would, if granted, interfere with his dam ; by Thomas Walsh, on the ground that it would interfere with his water right, which had been registered for years ; and by Thomas Wright, for a similar reason. Application refused, with costs and L 3 expenses. •
Carey v. Kenny.— Claim for L 4 13s Gd, a disputed balance in the partnership accouut between the parties. The case had been sent round from, the Resident Magistrate's Court. On defendant's name being called, he did not appear ; and on plaintiff proving the debt, a verdict was given in his favor. On thp case being decided, the' defendant came into Court and explained that he had nob heard his name called ; he &pp2ied for a rehearing. This was refused, and the Warden said t"he time of the Court and the public could not be frittered away waiting the convenience of parties whose names were on the cause list, and whose business it was to be in attendance. He had made it a rule of the Court, and it would be strictly observed, that the names of parties who did not answer when called should be struck out. The Court adjourned to the 17th August. ,
