Jas, Darling and party, — An application for a piece of surplus ground situated at Noble's Creek and held by defendants contrary to the gold fields regulations, Judgment fop defendants, without costs. S. M. Mackley v. Wm, Henry Lash.— ' For being in illegal possession of a house and a certain portion Of land, situated on Waipona Terrace, Noble's, the property of complainant. Judgment for plaintiff, the house to be handed over to plaintiff ; no costs. ■ Joseph Woolfe v. J, Brennan, Antonio's Flat. — A complaint that defendants had. cut away Woolfe and party's head race, thereby diverting a portion of their water. and converting it to their (Brebnau and . party's) own use. Damages were laid at Ll7. Plaintiffs were nonsuited, without costs, • William Gracy v, Geo. Bannon and Co, — An action for L 35 for wages for working at a race and in a claim at Noble's. De» fendants put in a contra account for L*l3 183 6d as a set-off. The Warden refused to admit the contra account in this shape, it would have to be tried as a separate action in the Resident Magistrate's Court, Judgment for L 35, with 11s costs. The, amount to be paid into Court forthwith, to abide the result of the cross-action, if the same be instituted before this dayweek; in default of payment into Court forthwith execution to issue withiu the usual time. The cross-action, Bannon v % Gracy for L73 18s 6d for goods supplied, has since been tried in the Resident Magistrate's Court, when plaintiffs were^ nonsuited with costs.
