. Thursday, November 25. (Before J. H. Lowe, Esq., R.M,) Richard Donovan was charged with. being drunk and disorderly at Napoleon on lGth inst, and fined 20s or 48 hours* imprisonment, - - :r-;._. . — ~- - — The same, prisoner was charged with stealing L 5, under the following circumstances, When prisoner was in the lockup at Napoleon on the previous charge, a man named Kennedy (a packer) consented to bail him out. He gave Sergeant W^lsh a five-pound note (which he described in, his evidence), for the purpose of taking the bail money, L£, out of it. Sergeant, Walsh laid the note on the table, . and directed Constable Paul to make out a, receipt. While this was being done* Sergeant Mayberry rode up to the door, on his way from the Ahanra, and his appearance drew the attention of the* other person who were in the camp at the time from the prisoner, who thus, if was. alleged for the prosecution, had an opportunity of taking the note. The witness, Kennedy then took his receipt and frent. away in company with prisoner, and when they reached the blacksmith's shop in the. , lower township he (witness) recollected that he had not received his change from, the constable. He told prisoner so, and prisoner told him to go back and get it, and he would wait fo^ i him at Stratford's, store. He re-. \ turned to, the camp and asked forhis change, and then the ncte was missed.. A careful search, was made for it, bnt it could not.be found. Sergeant Mayberry then searched the persons of Constables* Walsh and Paul, and the prosecutor, Ken-. nedy. On Walshes person two five-pound notes were found, but neither of them! bore the-'least resemblance to the missingnote, for it was a new one, and these wereold and worn. Constable Paul was then despatched to am s,t the prisoner, which jhe did at Stratford's store. He searched prisoner, but djd not find the note. Prix soner. in his defence, said that he did not take the note, and that a.ny of the otherpersons who were in the camp at the timehad just as good au opportunity of taking it as he had. Be asked, was it likely, if he had the note in his possession, when he was outside the camp door after being discharged on bail, he- would turn back, as he did, and ask one of. the constables, for a pipeful of tobacco, and then wait ta fill his pipe 'I Would he not go away ast quickly as he could and get rid of the note. if he had stolen it, for it was sure to be missed in a short time ? He said he had; always borne a good character, and even, if he had not, the greatest thief in London, would not be so ungrateful as to rob a. man — a perfect stranger to him— who had just bailed .-hini; put of the gaol. His-, ! Worship considered the" charge, proved^ and sentenced the prisoner to two. months' imprisonment.. Prisoner was removed,, loudly protesting his. innocence. I crvic cases. ! S M. Mackley.v. Wm. Henry Lash. — , An action to recover the sum of L 9 1165. sd, for goods 1 supplied to defendant at N.ible's. Judgment for amount claimed,. withLl 17s costs. Byrne v. Corcoran.— Claim for Lll 12s. 6d, for goods supplied at Duffer's Gully. This case, and the two following ones, were adjourned from last Court day for> the production of further evidence, and for the. production of' certain books and papers. After a long hearing, judgment was given for the amount claimed, with costs ; one-half, tlie amount to be paid} down, the balance within one month. Byrne v. Michael Connor. — Claim for LlO 6s for goods supplied. The evidence; in this case was somewhat similar to that given in the last one. Judgment for full amount claimed and costs ; cne-half to be paid down, and the balance within one. month. Byrne v. Denis Harrington. — Claim o£ Ll7 8s for goods. This case went with the two previous ones. Judgment for full amount and costs, L 5 to be paid at once* the balance in two months. -
