WARDEN'S COURT, AHAURA.
Thursday, November 25. (Before Mr Warden Lowe.) A. Boyle and party v. James Stanley and party, Callaghan's Gully.— Plaintiff complained against defendents that they had diverted the water from Callaghan's Creek, thereby depriving plaintiffs of their registered right. Damages were laid at LlO. Defendants deniel the diversion, and said that the water was run by them down their race (the head of which was above plaintiffs') a certain distance, and then delivered into plaintiff's above their (plaintiffe') workings, and that answered all practical purposes. The Warden took this view of the matter and gave a verdict for the defendents, with L 7 Us costs and expenses. Thomas Thomas and party v. Edwards and party. — An action for taking illegal possession of a portion of plamtiffs' cla,im at Moonlight. Judgment for plaintiff, with L 7 19a fine, cos!» and expenses, to be paid forthwith, or f onr weeks' imprisonment. The money was not paid. Thomaa Thomas and party v. John Brennan and party.— A complaint for taking forcible possession of plaintiffs' claim at Moonlight. Verdict for com- ' plainants, damages L 5, with costs L 3 9s. John Hamilton v. John Black, Little Grey Junction. — For taking illegal possession of a house at the junction, the property of complainant. Possession ordered to be given to coinplaiuu,nt, with costs, Us. On Saturday, 27. th inst., the Warden visited Callaghan's Creek and decided the rights of the different parties there as to priority. Burrell and party are to have the first right, Boyle and party the second, and Stanley and party the third right.
