Monday, September 7. (Before M. Keogh, Esq., RM.) Meagh and Co. v. Neuveivis and Go. — The defendants in this case took up a claim on the Eight Mile Terrace* about teu days back, and a rush having. taken place to the Candlelight Terrace two of them went there to prospect, alleging that they had parted from the other mates. After, however, being absent for four or five days, they returned and again joined their mates. The two following days being wet, little or no work was done on the claim, and on the Tuesday they worked. Meagh and party considering: that they were shepherding the ground took possession — hence the suit. Much, contradictory evidence was adduced on both sides. The defendants produced a. witness who swore that they had worked as wages-men would do. Mr Perkins, who appeared for the defendants, addressed the Court, after which Meagh. asked permission to bring forward another witness, but this the Warden refused to accede to, and gave judgment for the defendants, but without costs.
