George Thomas Osbaldiston and George^ - Hart were charged withTstealing one gold watch and chain from the person of Sydney James Jago, at Rutherglen, on A the morning of the 12th inst, , ~-m Mr Perkins appeared for the prisoners. J Sydney James Jago .; I was at Rnther- ■ glen last night, at a ball at Hamilton's 9 Hotel. After a time I went over to a m calico building, and lay down on a j9 stre toher, I fell asleep, with my clothes ~g on, When I lay down 1 had ah open 'fl faced gold watch and -an imitation gold Ig chain, a pocket book, and some money in * my possession. The watch produced is | my property. - 1 swear positively to. it. ■* The value of it is Lls. The chain is, to i the best of my belief, the same I had - ;„. attached to the watch when I fell asleep. ; I woke between five and six o'clock ihia • morning, and, found my watch and chain gone, and my. pocket boo'< taken put of my pocket and lying beside me. No other person was sleeping in the same room, The door was open,- and'people were going in and out. I saw both the prisoners during the evening acting as waiters at ■■'- the supper. When j woke there was a man named William's sitting by tfcefire in the room where I was, : Cross-examined by Mr Perkins, : I waa perfectly sober when I lay down. I had no occasion.to look at my watch, so I can 7 notswear I had it on me when I lay down, but I am morally certain I had it. Wm. Elsenv was examined, but beyond proving that he saw tha parties at the ball his evidence was not important. , Sergeant James Clements : I am star tioned at Rutherglen. From information received I proceeded to Hamilton's B otel, about 6 a, hi. this morning. Saw Mr Jago, who described a watch he. had lost. I saw the prisoner Osbaldiston there,; and asked ', * him if he had a watch about him. He said : ~ ■■& he had one of las own, and produced an | old silver one, saying it was the "only M watch he had. A part of the chainy was hanging out, 1 could not taketh|Vj..j watch out of his hand without assistances /J Prisoner persisted in saying he had J^B-' j watch in-, his hand till I took it out. Bar : .
