CHRISTCHURCH. Saturday, Septembbb 23. Rowdyism. —H. J. Benton was charged with being drunk and disorderly, and with an assault. J, O. Bowman deposed that about midnight on the previous night while passing along Colombo street, the prisoner followed, and remarked that he was no gentleman, following up the observation by a violent blow in the face. Witness had given no provocation whatever. Two other wit nesses corroborated the above statement. Constable Dougan stated that the prisoner before the assault had been behaving disorderly in the streets. He was sentenced to one month’s imprisonment with hard labor. Wifb Dbsbbtion. —James Qrinley, alias Nicholson, was brought up on this charge. Sergeant Mason said hi* was as heartless a case a* ever had been brought before the Court. The prisoner had nominated hi* wife and four children for assisted passages in November last. They arrived on September 3rd, and he had been notified of their movements. He had, however, not met his family, but had gone away with another woman, and had only been traced with great difficulty. His wife and family had been thrown on the Charitable Aid department. After evidence had been taken the prisoner denied moat of the above statements. He said he had been unfortunate. He had, however, a little money coming to him soon, and he would take his family away. The case was adjourned till September 29th to give him an opportunity to keep his word. AMBBBLBT. Thursday, Septembbb 21, [Before J. O. Porter, Ksq., 8.M., and A.. Broadfoot, Esq.] Civil Oases. —Public Trustee v S. M. Neville, claim of £IOO, due October, 878, under agreement in reference to estate of W. Collins, deceased. Mr Watson, for Mr Lynekey, who acted under power of attorney from the Public Trustee } Mr Holmes for defendant. Objection was taken to the power of attorney, the attesting witness not being present. It was decided that evidence of same might be taken at Wellington. Mr Watson proceeded to put in a former power of attorney from a previous trustee, which was objected to. He then proposed to hand in a report on the matter by the late Mr Hellish, 8.M., which was also objected to. I M. Lynskey said that proceedings were taken “in this matter at the Kaiepoi Court in No-

vember, 1876, of which tharecords were pro dooed. Judgment at that time was given against defendant for £IOO, and he agreed to pay further instalments. Witness could tell the exact amount of the debt by reference to the documents in Court. Mr Holmes objected. Witness said the agreement was made hy defendant to pay the amounts due to'Collins’ estate in 1874 Mr Holmes objected that the debt was beyond the time set out in the Statute of Limitations. Witness said defendant had offered since to settle it, and as late as that morning. Mr Holmes said he was prepared to show that the matter between deceased, Collins, and de fendant, was one of partnership, and that his client had paid certain sums iorder to assist in having the matter in dispute properly adjusted.
