OHBIBTOHUBOH. Friday, September 28. [Before O. Whitefoord, Escl, 8.M., and B. Westenra, Esq., J.P.'J Drunkenness. —Ellen Mitchell, for being drunk and disorderly, vm fined £l, or in default twenty .four hour*’ imprisonment with hard labor.
Malicious Injury to Pbotbbtt. Richard Martin was charged with maliciously damaging property belonging to James Bell. Mr MoConnel appeared for accused. The partiee are neighbours living at Woolaton. Accused claims that part of _ Bell's house stands on his ground, and a dispute having arisen about the turning adrift of Martin’s horse and the chopping down of a fence, Martin in retaliation broke in a window of Bell’s house. In doing so he broke some things that were standing inside the window. After hearing evidence tue Bench said, as to the window a question of title was involved, and the Court had no jurisdiction; but accused had no right to smash the other things. He was fined 5«, and ordered to pay for the damage, £2, or in default forty-eight hours’ imprisonment. The fine and damages were paid.
