Mr George Harper applied heroin for an order calling on defendants to show cause why the plaintiff's demurrer herein should i not be removed from Hokitika to ChristMr J. B. Fisher appeared for defendants and opposed the application. His Honor pointed out that no sittings in bunco were held in Hokitika, nor was it at all desirable that "banco sittings should be held in a place where there was not a strong bar. Mr Fisher submitted that the demurrer having been served in vacation it was _ a nullity, and no order could be made on it. He might also state that only one of the ( plaintiff a had been served with the de-

Mr Button applied herein for leave to invest the sum of £1320 on mortgage of land. His Honor made the order as prayed, and also for tho trustee's oosts. IN BE XINLBY. Mr J. O. Martin applied herein for an order directing the Public Trustee to pay out oertain monies, residue of sale of a paroelof land in the North Island under the Bating Aot. His Honor made an order for payment of the money and interest thereon. STUDHOLMB Y BHODK3. Mr Garrick applied herein for an order for payment out of Court of certain monies in this oause. Mr George Harper and Mr H. N. N-'der alsojjappeared to oonsent. The order was made. BYANS Y BAW6TON. Mr Bruges applied for an order dismissing this action for want of prosecution. Mr Joyce, for Mr Loughrey, moved herein for a similar order. Mr Bruges appeared for the plaintiff, end stated he had no objection to the order if it went without costs, to whioh Mr Joyce objected. Hi* Honor made an order dismissing the aotion absolutely, but without costs. BB HUGH WBIOHT, A IUNATIO. Mr Douglas moved for an order giving the guardian leave to sell part of R.S. 145, and also to lease certain other part of the same seotion. His Honor said he thought it would be better to have the affidavits of some estate agent as to the prioo being a reasonable one. Ultimately his Honor made the order, referring the matter to the Registrar to enquire into and report upon. NATHAN T STOCKS. Mr Joynt applied horein for on order for leave to appear and defend action. His Honor made the order as prayed, giving leave to appear and plead within eight days of delivery of declaration. BE H L. TOSTBB. Mr Joynt applied herein for the appoint ment of H. Tj. Foster as a commissioner for taking the acknowledgments of married women for the Middle lilai.d. His Honor made the order. Mr Izard applied herein for an order granting probate herein to John Barrett. His Honor made the order as prayed. BB JAMBS FLINT, DBOHASED. Mr George Harper applied for probate to Maria Flint, George Pieroy, and Thonias Papprill. His Honor made the order. BB W. J. KSBB, DEOBASBD. TOI7NG T HILIi AND OXHBB9, In this oaße, which has been before tho Court in various shapes during the last two years, now came up for argument on a point of law raised at tho trial of tho case at nisi prius. Mr Stout, with r.iax Mr Oook, for the plaintiff, acd Mr George Harper for defendants.
On the motion of Mr George Harper, the Registrar read the record of the nisi print trial, with a view of comparing it with the declaration.
Tho cace was then argued by the lea\fled counsel cngagod, and was proceeding whon we went to press.
