For first offences two men were eaoh fined ss. John Baasford, who while drunk had made use of obscene language in a publio thoroughfare, was fined 10a, or in default forty eight hours' imprisonment. John Hawker, alias Williams, who came up in a filthy condition, and who appeared to be in a state of extraordinary debility, was proved to have while drunk gone to various shops begging. Having been previously oonvioted, he was sent as a rogue and vagabond to gaol for three months, to be kept to hard labor. Constable Stacey stated that on receiving certain information on Thursday, at about two o'olook, he followed prisoner in Cathedral square. charged with selling liquor on Sunday last to ', unprivileged persons. Mr H. N. Nalder ap- { reared for the defence. Charles Smith, alias Kelly, able seaman, belonging to the ship Kangitiki, said he, with the boatswain of the ship Selirr/, had some liquor on Sunday morning. They were on the " buret." Sergeant Morioe forbade asking «ny further questions, and called John Kelly, of the ship Ravenscrag, who said he was with the last witness last Sunday in the British Hotel, and they had three beers together. He got looked up afterwards, and was undergoing a sentence of fourteen days for being drunk and disorderly. He waß "tight " on Saturday night, and took a bottle of " Dnnville's " aboard—"rattling good stuff it was, too." The witness said defendant, at one o'clock on Sunday, told him to leave the house, and he left. Altogether, he had eight or nine drinks on Bunday morning. Further witnesses were called by the polioe, but Sergeant Morice stated they t >ld a different story to the Court to that which they had made to him. Defendant, sworn, said the witnesses Kelly were not supplied with drink in his house. They were drunk when they came in, and he put them out, Mrs Haxell gave similar evidence. Case dismissed. The Sergeant said ho quite agreed with the decision, and he would not have brought the case on had the witnesses on last Tuesday sail to him what they had now stated in evidence. A similar oharge was preferred against J. Bryant Hill, of the Mitre Hotel. The first witness called when questioned commenced by "not remembering," and the prosecution "desisted from further questioning. A seoond witness, a third, and a" fourth were called with the same result. The man Kelly, called in the previous oase. and who was still a prisoner, testified tc having been in the Mitre Hotel with some oi the previous witnesses and had driaka there, J. B. Hill, the defendant, denied that a j drink was served to Kelly on Sunday. Ths Bench dismissed the case.
