DISTRICT COURT.

CHRISTCHURCH. Monday, Maeoh 13. [Before His Honor Judge Ward.] The Court sat at two o’clock. HINTON AND PBIOB V LANDBEQAN. Mr Holmes for the plaintiffs, and Mr Joynt for the defendant. The hearing of this case was resumed. It was an action to recover the sum of £l6B 12s lOd, alleged to be due on a contract to build a house at Ohriitohnroh. The defence was that the house was improperly built. The ease for the plaintiffs was heard on the previous Court day, and one witness was examined for the defendant. Mr Joynt now stated that his next witness, Mr J. O. Maddison, without whom it was impossible to proceed, had been served with a subpoena, but refused to attend, stating that he was disgusted and annoyed at being summoned, and if brought into Court would

refuse to give evidence. He uked the Oou for an order to compel the attendance of tne witness. Mr Maddison had made m amination of the building, and he desired to obtain his evidence as an expert. The summoning officer was called, and deposed to having served the subpoena. By the Court—There was no tender made of the witnesses’ expenses. His Honor said that being the ease, he could not make the order required. Tbo case was therefore adjourned until next Court day, on payment of the costs of the day, a fresh subpoena to bo served on the witness, J. 0. Maddison. The Court then adjourned.
