SUPREME COURT.
CHRISTCHURCH. Friday, August 26. SITTINGS IN CHAMBERS. [Before His Honor Mr Justice Johnston.] His Honor sat in the Court Chambers at 11 a.m. BE PETITION OF M. A. RHODES. Mr Travers appeared herein for an order under the Leases and Sales of Settled Estates Act, vesting a general power of leasing in the trustees of the will of George Rhodes. The parties interested were represented, and consented. His Honor made the order as prayed, the undertaking to be recited. Costs to be paid out of the estate as between solicitor and client, EE WILL OF WILLIAM AMOS, DECEASED. Mr Garrick applied herein for an order appointing the mother of the infant children of the testator as guardian, and appropriating a certain amount of the estate towards the support of such children. The question for the Court to decide was, whether the widow of deceased, having married in the meanwhile, the trustees were bound to appropriate th* interest arising out of a certain portion of the estate for the maintenance of the children, they being entitled only to a share of the property on arriving at the age of twenty-one. Mr Button, for the trustees, said he did not appear as antagonistic. Al' that was wanted, was the direction of the Court on the matter. His Honor, after consideration, said that the true construction of the will was that the trustees, on the second marriage of the widow, were justified in dealing with the estate for the maintenance of the children until they arrived at the ago of twenty-one. The order would be as prayed, costs of both sides to be paid out of the estate, EE JAMES PALLANT, A DEBTOR. Mr Douglas applied for an order herein calling upon the trustee, Edward George, to show cause why he should not pay the debtor’s costs referred to in an order of the Court of March 15th, His Honor granted a summons as prayed
