OHBIBTOHUBOH. Wednesday, August 10. (Before J. Nugent Wood, E,q., 8.M.) OIYID Oases. — Kerr v Bevin, £5 9s for groceries, Ac,, supplied. Judgment for plaintiff with costs of Court and solicitor’s fee.—Mr Joyce for plaintiff. Bowem v Gillin and Devery, £36 ss. Mr Loughrey for plaintiff, and Mr Button for defendant. This was a claim for balance of commission on the sale of a hotel. Plaintiff claimed at the rate of 2J per cent, on £1450, the amount of cash paid by the purchaser. Defendant now resisted the claim on the ground that a special agreement for this service for £ls had been made between the parties. £7 had been paid into Court. After some evidence had been taken Mr Button applied for a nonsuit, as plaintiff was an uncertificated bankrupt. Mr Loughrey objected to this, as there was nothing to prevent plaintiff from suing for work and labor done, under which category he maintained the present claim came. Mr Button then withdrew his application. It appeared finally that the cash obtained by plaintiff’s agency was only £llOO, the balance being the result of a separate negotiation by one of the defendants, and judgment was given for plaintiff for £27 10s, less the amount paid in, with costs of Court and solicitor’s fee, £2 2s.—Tisoh v Qarety, £6 7s 6d ; judgment for plaintiff for £3 11s 6d.—Garety v Tisoh, £SO; judgment for defendant.
