Mr Turnbull appeared on behalf of plaintiff (who had previously appeared in person, but was called away to Auckland) to move the Court to fix the time and place of trial. Mr Garrick appeared for the defence, and applied for a special jury. . The trial was fixed to take place at Christchurch on Wednesday, January 12th, 1881. BB J. Williams applied for an order for the payment of certain moneys by the doeeated’s administratrix. His Honor refused the order on the ground that the money could not be traced. TUB 110 WOBES ACT AND CLAIM OF KBITH AND OTHBBS. On Mr Joynt’s application herein, His Honor granted a rule nisi, claimants to show cause why their claim filed as a judgment should uot be set aside. Mr Harper, who appeared for the defendant, said there were a number of other summonses against the same defendant, and he abandoned the summonses in all oases. Mr Spackman, for the other side, submitted that the application was quite unnecessary, he having expressed no unwillingness to have the bill of costs taxed. The application, as prayed, was granted. After hearing arguments of counsel. His Honor granted leave to issue certain interrogatories, to be answered one month after .service. This conclnded the list of oases.

Mr Garrick appeared for the trustees to show {cause against the rule, supporting the rejection by the trustees. Mr Joynt appeared on behalf of the claimant in support of the proof. A considerable amount of evidence had been taken by commission and otherwise,

which was reviewed by counsel at considerable length. tfii Honor said he would take time to consider bis judgment. The Court then adjourned till Friday next.
