LYTTELTON. Fsidat, Octobbe 22. [Before J. Beswiek, Esq., E.M., and T. H. Pott*, Esq., J.P. Civil Business. Bobimon v Walters, claim £1 12a 6d. Mr Nalder for the defendant, -who had paid £1 4s into ConrtSince the debt had been contracted plaintiff had asaigned his property to trustee for the benefit of his creditor*. Mr H. N. Nalder submitted that plaintiff must be nonsuited. Judgment for amount paid into Court, without coat*. Nalder v Opie, claim £2 19a; judgment for amount and costs. Oathro r Jones, claim 14s ; judgment for amount claimed and costs.
