Supreme Court of New Zealand by MR CHARLES NAPIER BELL, of Chriatchurch, Civil Engineer, against us, the undersigned Proprietors of the " Raniiiora and North Canterbury Standard," in which damages are sought to be reaovered by Mr Bell for the publication of a libel contained in an article hereafter Bet forth, and Mr Bell having consented to discontinue the action upon payment by us of all costs incurred by him, and upon the insertion of the following APOLOGY in the leading newspapers throughout the colony : We therefore hereby beg to apologise to Mr Charles Napier Bell, of Chrihtchuroh, Civil Engineer, for the insertion of the following article in the issue of our paper of the twentysecond day of May, and again on the sixteenth day of June last, and we farther state that wo are satisfied that the facts expressed and implied with reference to Mr Bell in the said article are altogether untrue and unfounded, and we beg to withdraw the statements containedin them :
" Architects in New Zealand, and in the goody-goody city of Christchurch notoriously, have often times carried ont with Buccess the good—or bad—old .English custom of exacting a percentage upon the value of material they implied in their specifications. We remember, well, for example, Sir Cracroft Wilson elevating his powerful voice in the Provincial Council against the practice of a then Provincial Arohitect demanding 5 per cent, from a certain quarry proprietor, if he—the architect—directed in his specifications that the stone to be used came from the quarry of the quarry proprietor in question. We are told that in the matter of the pipes ordered from England by the Drainage Board for the purpose of the Christchurch district, that, according to ' usage immemorial' —savo the mark—from a colonial taxpayer's point of view—the engineer of the Drainage Board, Mr Bell, through whoso hands the ordering of drainage piping to England is made, is to get 5 per cent, upon the English price of the pipes. A larger percentage is even stated. Now we can scarcely believe this. The last contract for pipes amounted to some £33,000. At 5 per cent. ; the sum netted by Mr Bell would be a very tidy one.
