A MEDICAL CASE.

J The following case was heard yesterday in I the Resident Magistrate's Court: — I Grimes v Townend, £52 7s; Mr Izard for plaintiff, Mr Garrick, with him Mr Salter, for defendant. Plaintiff alleged that an agreement had been entered into between himself and defendant about October, 1878, by which tho latter employed him as assistant in his praotioe as surgeon and physician, undertaking to provide employment for plaintiff sufficient to produce him £350 per annum. If the amount earned did not reach that sum defendant was to pay the rent of a house which plaintiff oocupied at the instance of Dr. Townend for their mutual convenience. Further terms were, that in all midwifery cases plaintiff was to receive the whole of the fees paid and half fees for any cases which both ho and Dr. Townend treated. Dr. Townend hired the house and paid the rent for the first six months, after which the house was transferred to plaintiff, but in all other respects plaintiff considered the agreement to stand as at first. For the first year the arrangement worked

! satisfactorily, but for the last six months Dr. Townend had taken another assistant, and the business entrusted to Dr. Grimes had consequently dwindled to very small proportions. Plaintiff now sued for £l7 17s, due for fees in midwifery oases, and £35, one half year's rent of the house. No written agreement between the parties existed. For the defence it was contended that Grimes had never been engaged as an assistant ; nor, after the first six months, had there been any guarantee by Dr. Townend, either of rent or amount of practice, Dr. Grinaes merely receiving _ Dr. Townend'o recommendation to such patients as the latter could not treat. After hearing evidence, which occupied nearly the whole day, the Bench was of opinion that plaintiff had no claim on Dr. Townend, and judgment was given for defendant with costs.
