SITTINGS m OHAMBEBS. Fbiday, July 2. [Before His Honor Mr Justice Johnston.] His Honor sat in Chambers at 11 a.m. BBABBR, OHABTE2S AND CO. V. WILBON. Mr Holme3 appeared for the defendant, and applied for an order directing the issue of interrogatories to the plaintiffs. Mr McConnel, for the plaintiffs, consented to the order. Order by consent. WILSON V. DBAPEB, CHAETBBS AND CO. In this case a similar order for the delivery of interrogatories to the defendants herein was made on the application of Mr Holmes. WILSON V. DEAPEB, CHABTEBS AND CO. This was an action brought by Mr Wilson against the dofendauts for the recovery of certain books, documents, and promissory notes, alleged to be in the possession of the defendants. Mr McOonnol, for defendants, now moved for an order c ailing upon the plaintiff to show wubo why the defendants should not have three days' further time to plead heroin. Mr Holmes, for the plaintiff, appeared to opposed the application. Mr McOocnel read affidavits filod by him in the matter. His Honor said that the affidavit submitting that Mr McOannel had an impression on hi* mind as to what had taken place, was not sufficient. Mr McConnel asked for the«postponement of the case. His Honor asked Mr Holmes whether he would agree to the granting of time on terms. Mr Holmes replied in the negative. Mr McOonnel submitted that there had teen no laches on his part. He understood that he was to have a further extension of time for fourteen days. Mr Oorr, the clerk •of the plaintiff's solicitor, had given him to understand that if ho did not hear from him there would be fonrteenidays' time given to plead. Mr Holmes read a paragraph from the affidavit of Mr Oorr. His Honor said, as there was a conflict of -evidence, Mr Holmes had better arrange to allow this matter on terms. Ultimately the Court granted three days further time to plead, on payment of costs. PUBLIC WOBKS ACT AND BE CLAIM OP DAVID -WHITE. In this case Mr Perceval applied for an order fixing the date of a Compensation Court under the Aot.. Messrs Matson and J. T. Ford had been appointed as assessors. Mr Ootterill appeared on behalf of the Minister for Public Works. His Honor fixed Monday, July 26th, at 10 a.m., as the date for holding the Court as requested. . • BANTIN V. BDELMAN. In this case Mr Perceval applied for an order giving possession under 122nd section of the Land Transfer Act of certain sections of land. A. summons had been issued calling upon the defendant to show cause, but no one appeared, the defendant being absent from the colony. The plaintiff now camo to the Court for an order giving him possession. Order for possession as prayed. BAUNDBBS V. DELAHAIN. Mr Bruges applied for leave to amend the issues herein, and for the insertion of an additional issue proposed by the defendant. Mr Harper appeared to consent on behalf of the plaintiff. Order by consent. BE GBOBGB QtTIGLBY, DECEASED. Mr Gresson applied for an extension of time for sending in accounts herein. His Honor made an order extending the time to a twelvemonth from time of granting the order. BE GEOEGE LOEIJIER, DECEASED. _ Mr Gresson obtained an order herein for administration to James Lorimer. BE THOMAS DEVEBY. Mr Thompson, for Mr Salter, applied for an order of discharge herein. His Honor made tho order. BB FBBDE. COLLINS. This was a similar application, and his Honor made the order. BB G. T. CLASS. Mr Thompson applied on behalf of Alexander Munro, a creditor of the above-men-tioned Clark, for a summons calling on the debtor to show cause why an order of adjudication should not issue, on the ground that he had departed from out of the jurisdiction. His Honor made an order granting the summons returnable on Tuesday, July 20th. The summons to be served on the last known place of abode of the debtor. BE J. BLAIB, DECEASED. Mr Ootterill applied for probate to W. Strange and J. T. Simpson as exeoutors. His Honor made the order. BE JAKES HAY, DBCEASBD. Mr Ootterill applied herein for letters of administration with will and codicil annexed to John Hay, as next of kin to the deceased. TTi« Honor granted the application.
