SITTINGS IN CHAMBERS. Tuesday, June 8. [Before His Honor Mr Justice Johnston.J His Honor sat in the Court Chambers at 11 a.m.
BE JAMES TREGEA.GLE, DECEASED. Mr Salter applied herein for letters of administration to the widow. His Honor mode the order as prayed. HILL AND OTHERS V YOUNG.
Mr Joynt, for the defendant, appeared to apply for an order directing interrogatories to issue herein. Mr George Harper, contra, opposed, on the ground that interrogatories would intercept the going to trial with the cause. After argument by learned counsel, Mr Harper said he was so wishful to get the caae for trial, that he would undertake to accept the interrogatories, and answer them in twentyfonr hours instead of the usual eight days. Mr Joynt pointed out that a cros9 action had been brought by the defendant in this case against the present plaintiffs to get an injunction to restrain the present plaintiffs from proceeding with this action. His Honor pointed out that if Mr Joynt allowed the issues proposed by Mr Harper to be settled now and the case got ready for trial, he would be in this position that if the verdict was in his favor there would be no need to goon with the action; en the other hand, the action being pending would stay execution until the cross action was heard. After further argument, His Honor said he would grant Mr Joynt'a order to issue interrogatories, and he would also grant Mr Harper's motion for settling issues and fixing time and place of trial. Order —Issues settled ; interrogatories to issue to Messrs J. T. Ford and Charles Newton; to be answered in six days. Trial to take place at Christchurch on 15th July by special jury. RE GEORGE SAMUEL TAYLOB, DECEASED. Mr McConnel applied herein for probate to Mary Ann Taylor, widow of deceased, as sole executrix. His Honor made the order as prayed.
RE THOMAS EASTEHBROOK, DECEASED. Mr George Harper applied for probate to John Easterbrook as executor named. His Honor granted the application.
ETANS V. BANK OF NEW SOUTH WALES. Mr Joynt appeared, on behalf of plaintiff, to ask for further time to plead, and for the trustee of the plaintiff to decide whether ha would g« on with the action. His Honor pointed out that there was no affidavit filed on the plaintiff's Bide Betting forth any grounds why the further time should be given. Of course this was not Mr Joynt's fault. Mr Garrick Baid he had been instructed to oppose this motion, and had filed an affidavit that he had received information from Mr Tabateau, manager of the Bank of Now South Wales at Napier, that the creditors had declined to proceed further with the action. His Honor would decline to grant Mr Joynt's motion, with coßts. FORD AND ANOTHER V MACINTOSH. On the application of Mr Harper, the issu3s herein were settled, and the time of trial fixed for July 16th, by special jury. HE CHARLES JAMES GRAHAM. Mr Garrick applied herein for jan order appointing a gnardian of tho infant. Mr Harper appearod and opposed the order on •the ground that the matter was subjuMee, his Honor Mr Justice Williams having had the case before him, and a reference made to the Hegisrar at Dunedin. The caae . ordered to stand over.
1.38 JFBJtDK. WH.DINO. _ . Mr George Harper applied for the admission of Mr Wilding as a solicitor of the Supreme Court of New Zealand. His Honor Baid he had much pleasure in admitting Mr Wilding. Mr Spackman moved for the admission of the janio gentleman aa a harriater of the Court. His Honor made the order.
