MAGISTRATES' COURTS.

CHBISTCHUBOH. Sattjbday, Deobmbkb 20. [Before Gh L. Mellisb, Esq., B.M.] Fobgbby and Uttbbing.—Danl. O'Brien, alias John Foley, was charged with forging and uttering a cheque for £lO on the Union Bank of Australia, Temuka. Austin Kirby, a deteotive omoer stationed in Timaru, stated that on the 18th inst. he arrested the prisoner on a warrant charging him under the name of John Foley with forgery. The prisoner, in reply to the charge, said ho had been at Ohristchuroh races, and had loßt £5 in bets ; that while there he, had two friends with him, and he told one of them he had lost all his money, and that one of them lent him £2. A few days afterwards a brother of the person that had lent him the money told him that if he did not pay him he would knock his head off. He was afraid of him, and went into one of the hotels, he believed the White Hart, and got a blink cheque, and signed it in his own name Darnel O'Brien, and endorsed it in the name of John Foley. He had a friend at the Kukaku, and he behoved his name was John Foley, but he had since ascertained it was Androw McCarthy. McCarthy often had told him if he wanted money to let him know, and ho would send him some. He also believed McCartney had a banking account at TemuVa, and he did not think he was doing any harm in endorsing Foley's name to the- cheque. Ho subsequently gave the cheque to Mr Barrett, hotel-keeper, Christchurch, who gave him a few pounds on it. There was no branch of the Union Bank at Temuka. When witness arrested the prisoner, the latter said his name waß Daniel O'Brien. A mat 9of the prisoner, named Foley, resided at Timaru, but there was no one of that name at Kakahu. On the application of Mr Inspector Hickson, tho prisoner was remanded until Tuesday, tho 22nd inst.
