SITTINGS IN CHAMBERS. Feiday, Octobeb24. [Before His Honor, Mr Justice Johnston.] Hia Honor sat in the Court Chambers at 11 a.m. GLEN T BHUTAN. Mr McConnel applied herein for an order, changing the solicitor on the record in this caae. Mr Thomas had consented to the change being made from himself to Mr McConnel. Order as prayed by consent. BB JAMES I.ONQ FLEMING. Mr McConnel applied for an order declaring complete execution of the deed of arrangement herein. Hia Honor made the order declaring the deed completely executed. BB BETJBBN BINSTEAD. Dr. Foster applied herein for an order, confirming a resolution of first meeting of creditors that the bankrupt should be allowed to continue hia trade under inspectorship. Hia Honor made the order as prayed. BE MICnAEL TBEOONNIN&. Mr McConnel applied for an order on the petition of H. S. Hobday, a creditor of the above-named debtor, issuing a aummons calling upon the debtor to show cause why he should not be adjudicated bankrupt. Hia Honor made the order as prayed. BB ABTHTJB KENNEDY. On the application of Mr McConnel, an order waa made for payment of costs herein. ll'liKAN AND ANOTHEB V OSTLER.. Mr Thomas, as agent for Perry and Perry, applied herein for leave to enter up judgment for £4Ol 9s 8d in default of plea. Hia Honor made the order, entering up judgment for £404 9s 8d and intereat. WILL OP HENBY ELLIS, DECEASED. I On the application of Mr Salter, his Honor made an order issuing probate herein to Georgina Ellis, aa widow and sole executrix. WILL OF BICHABD NOCK, DECEASED. Mr J. S. Williams applied herein for letters of administration, with will annexed, to Sarah Nock as widow. Hia Honor made the order. WILL OTf W. r. MOETON. Mr Thomas applied herein for probate to Loveday Morton as widow and sole executrix of the said will. Order as prayed. WILL OF THOMAS MABEBLY HASSAL. Mr George Harper applied for probate to Emma Hassal and Joseph Martin Heywood aa executrix and executor, reaerving leave for rederick Banks to come inland prove. His Honor made the order as prayed. ASHTON AND ANOTHEB V M'CLATCHIB AND ANOTHEB. Mr Joynt applied herein for an order enlarging the time to plead. Mr George Harper appeared on the other side and opposed the enlargement of the time.
After argument Hia Honor granted a month's further time on payment of Mr Harper's costs. His Honor made orders of discharges in the following cases : —Caleb Dalley (Mr Slater), J. H. Pass and W. Stringer (Mr Garrick), C. W. H. Woledge (in" person), Wm. Ruddy (Mr Slater), Samuel Jacobs (in person), David Raid (Mr Thompson), Thomaa Atkineon (Mr Cotterill), Wm. Matthewe (Mr Slater), H. M. Goodger (Mr Thomas), Thos. Johnston (Mr Thomas), Thomaa H. Lodge (Mr Thomaa), John Dalziel (Mr Thomaa), David Baird (Mr Thomas). CBOSS V BABKEB. Mr Thompson applied for leave to appear and plead on the ground of a aet off due by plaintiff to defendant exceeding the amount claimed by the action. Hia Honor made the order. THEOBALD V STUDHOLMB. Mr Joynt applied, on behalf of plaintiff, for an order removing the trial of this cause from Timaru to Dunedin. Mr G. Harper appeared for defendant, and said he would leave the matter in the handa of the Court. Hia Honor thought it would be aa well if the caae was heard at Dunedin. Order, venue to be changed to Dunedin. Trial at next sittings there by special jury (applied for by defendant) at such date as may be arranged by his Honor Mr Justice Williams. The additional costs of witnesses, being the difference between the trial of the of the cause in Dunedin and Timaru, be paid by defendant in any event.
