DISTRICT COURT. • Tuesday, Sbftembeb 23. [Before His Honor Judge WardJ His Honor took his seat at 11 a.m. TWENTYMAN AND OTHERS V. J. JEBSON. In this case the plaintiffs, as trustees of the estate of Isaac Brentnall Sheath, claimed £226 0 6d, balance due on an award. The defence was that the plaintiffs, as trustees of the said J. B. Sheath, were indebted to the firm of Jebson Bros., of Malvern, for work done, in a sum equal to that now sued for, and that Jebson Bros, had assigned this debt over to defendant, of which the plaintiffs had notice. This sum the defendant alleged was still due and owing by plaintiffs to him. The defendant further claimed a sot-off as royalty for certain coal taken out by the plaintiffs. Mr GUrrick appeared for the plaintiffs. Dr. Foster for the defendant. The evidence was mainly documentary. Mr Garrick said the issues between the parties were—(l) the right of set-off in respect to certain royalties on the working of coal, and (2) the right of set-off of £l5O on the assigned debt, alleged to be due by the trustees to Jebßon Bros. For the defence Dr. Foster called Messrs John and Bichard Jebson, who gave evidence of the transactions between the plaintiffs and themselves. His Honor gave judgment for £32 5s 4ii and costs.
