MAGISTRATES’ COURTS.
LYTTELTON. Wednesday, Judy 30. [Before J. Beswick, Esq., B.M.] CiTXD Cases. —Joseph Page v Eichard Gamol, claim £5 15s, for use and occupation of a cottage in Dampier’s Bay. Mr Nalder for plaintiff, Mr Joyce for defendant. Plaintiff said ho purchased the place from Mr J. Fletcher, and paid £2O on account (receipt produced), he had since asked defendant to pay, and the latter refused. Got an order from Fletcher for possession of the promises. Cross-examined : "When X took the order to defendant, he took no notice of it, and at a second time ho pushed me off the steps, I bought the place in April from Fletcher, got no deed, because I hadn’t paid all ths money. Completed the purchase with, and got the deed from Mr Euxton, Fletcher could not be found. Defendant was not put in the
box, defence being that there wai nothingidentifying the plaintiff and defendant as landlord and tenant. Plaintiff contended that the question of title could not be raised. The Bench entered a non-suit, plaintiff to pay cost* and counsel fee, £1 Is.
