In this case Mr Joynt stated that a settlement had been come to between the parties. WILKIN AND CO. T JOBIIN. In this case judgment was entered up for £ll6 15a 2d by consent. BATJNDBBS' TBITSTBB3 V BOBINSON. Judgment by consent was entered for plaintiff herein. P. AND D. DTTNOAN T B. AND B. SATJNDBBa. This was an action by P. and D. Duncan against S. and IS. Saunders, of Ashburton, to recover £l5O for work and labor done. The defendants alleged that before action was brought the plaintiffs, having the option of taking cash.elected to take the promissory note of W. Saunders for the amount due to them, thus extinguishing tho claim of plaintiffs against defendants. Mr Joynt appeared for plaintiffs, Mr Garrick for defendants. Mr Joynt called one of the plaintiffs, Mr Peter Duncan, in support of the claim, who stated that on December 31st they had taken a promissory note from Mr W. Saunders for £l5O. A day or two after they received a cheque from Saunders Bros., Ashburton, for £l3O, which they returned, stating that they had received a promissory note from Mr W. Saunders for £l5O. After taking the evidence of Mr Duncan, the case was, at the request of Mr Garrick, and with Mr Joynt's consent, adjourned till Wednesday next. The Court then rose.
