IN CHAMBERS. Tuesday, September 17. [Before his Honor Mr Justice Johnston.] His Honor sat in the Court House at 11 a.m. YOUNG- V HASSAL. In this case Mr Joynt appeared for the plaintiff, and moved for settlement of issues and fixing of time and place of trial. Mr Garrick for defendant. The issues were settled, and the time for trial fixed for the next sittings at Nisi, Print in Christchurch, on Wednesday, October 23rd, by special jury. CLEAVE V KINO AND ANOTHER. Mr George Harper appeared to ask for leave to issue a commission to W. Smart, Eegistrar of the Supreme Court of Invercargill, to give evidence on the part of the plaintiff. Mr Garrick, on the part of the defendant, consented to the order being made, leave being reserved to defendants to cross-examine. His Honor made the order. IN BANCO. EEGINA V. GREEN AND CUNNINGHAM V. DANN. In these cases, by request of the counsel engaged, his Honor made an order adjourning them until next banco sittings. MANSON V. HEATHCOTE ROAD BOARD. Mr Garrick asked his Honor if he was prepared to give judgment in the case of Manson Y. Heathcote Road Board ? His Honor said that he had made an interim draft of judgment, but Mr Justice Williams had been so much occupied in Dunedin that he had not had time to look over it. In view of the importance of the case, they had thought that perhaps it would bo better to leave the judgment over until after the sitting of the Court of Appeal.
