SUPREME COURT.

SITTINGS IN BANCO. Wednesday, August 14th

[Before His Honor Mr Justice Johnston and His Honor Mr Justice Williams.] Their Honors sat in banco at 11 a.m. EE THOMAS HOSIER REEVES.

This was a petition by H. Bell Johnston, as the attorney of several relatives of the above Thomas Hosier Reeves, claiming for and on behalf of them to be declared heirs at law' of a certain piece of land, comprising 200 acres, sit uate in the Mandeville district. The case was that Thomas Hosier Reeves came to Canterbury in 1851 and purchased the land above spoken of, and in 1852 left Canterbury for Australia, it was believed, and was never beard of by the family. The father of Thomas Hosier Reeves died in 1863, and it was submitted that if the father died after the said Thomas Hosier Reeves, he (the father) would bo the heir at law during his life, and such being the case, the relatives now applying, being the executors and trustees under the said will of the father. If, on the other hand, Thomas Hosier Reeves died after his father, then one of the claimants, the brother of the said Thomas Hosier Reeves, would become the heir at law of his brother. Mr George Harper appeared for the petitioner. Mr Garrick for the Public Trustee. Mr Wynn Williams, for Mr Lee, a claimant as to 100 acres of the property, Mr Garrick stated that he appeared for the Public Trustee to consent to the application

of the petitioner so far as regarded 100 acres Mr Harper then proceeded to open the case for the petitioner, and read the power of attorney from the devisees and heirs to Harry Bell Johnston, the present petitioner, letters from Thomas Hosier Beeves to his parents, and also affidavits in /ho case. . After some argument, the following order ■was made by consent Petition heard to be amended; 'decree to go for 100 acres to petitioner, being eastern halt ot section Zui, Harewood district; the Public Trustee to have his costs, and Mr Johnston to concur in the decree, .
