SITTINGS AT NISI PRIUS. Monday, Jttiy 15. [Before His Honor Mr Justice Johnston and a Special Jury.") BANKIN' V. NOEWICH INSURANCE COMPANY The following is a report of the proceedings of the Court after we went to press yesterday : Mr Garrick then opened the case for the defence, and called James Glanville, T. J. Gee, and F. Strouts. The two former deposed to haying tendered to erect the building as it was before the fire for under £4-00. Mr Strouts’ evidence went mainly to prove that the specifications and plans upon which the company had invited the tenders spoken of by the previous witnesses, would have reinstated the house in as good condition os it was in prior to the fire. The learned counsel on both sides having addressed the jury, His Honor summed up and the jury retired. After a short consultation they returned into Court with the foil >wing answers to the issues submitted to them : Did the plaintiff suffer damage and loss on the premises to the amount of £SOO ? Yes. Was the sum of £4OO paid by the defendants to the plaintiff the total amount of loss suffered by the plaintiff in the burning, damage, and destruction of the premises ? No. Was the sum of £4OO a full indemnity to the plaintiff for the said loss and damage P No. What sum of money (if any) is the plaintiff entitled to recover from the defendant over and above the said sum of £4OO paid by the defendants to the plaintiff as aforesaid, on account of the loss sustained by the plaintiff as aforesaid ? £IOO and 8 per cent interest for thirteen months. The Court then adjourned to 10 a.m. on Wednesday next.
