SITTINGS IN CHAMBEKS. Monday, December 10. [Before his Honor Mr Justice Johnston.] His Honor sat in the Court Chambers at 11 a.m. HEWLINGS V. MANDEVILLE AND RANGIORA ROAD BOARD. In this case the issues were settled, and next civil sittings of the Supreme Court at Christchurch fixed for time and place of trial. Mr G. Harper for plaintiff; Mr Joynt for defendant. TODD V. TODD. In this case, which was a petition for a judicial [separation on the ground of cruelty and adultery, Mr Harper applied for further directions as to the proceedings for the trial of issues of fact. By rule 44 he was entitled to come to the Court, and he would now ask his Honor to direct whether the questions of fact should he tried by a jury or brought under judicial notice by affidavit. His Honor directed the issues of fact to be tried before a common jury at the January sittings of the Supreme Court at Christchurch. GOODS OF TVM. PATERSON, DECEASED, INTESTATE. Mr Thomas applied herein for letters of administration to the widow of deceased. His Honor made the order. GOODS OF J. C. COOKE, DECEASED, INTESTATE. Mr George Harper obtained an order, issuing letters of administration to Leonard Harper, as attorney for the next of kin. RE WILL OF BENJAMIN QTJTNDON, DECEASED. Mr Geo. Harper applied for probate herein to the widow of the deceased as sole executrix. His Honor made the order. WILL OE THOMAS WARNER, DECEASED. On the application of Mr J. S. Williams, an order was made issuing probate herein to executors named in will. WILL OE AARON FRANKTSH, DECEASED. In this case Mr J. S. Williams applied for a similar order. Probate granted asjprayed to executors named. RE PETITION OF FANNY MRSSENT AND OTHER INFANTS. Mr Thomas applied herein for an order approving of the conditional lease granted by the trustee and guardian herein. His Honor made an order referring the lease to the Kegistrar for his report thereon, the order to be granted subject to Begistrar's approval of terms of conditional lease. IN RE DEBTORS AND CREDITOBS ACT. Under this Act there were a number of applications for costs. They were granted in the following cases :—E. W. Morey, Thomas Lee, N. P. Meyers, W. Smith, Antonio Lardi, J. H. Herdson, P. O'Brien, W. W. Harrison, Bamford and Priest, and M. H. Smith. DISCHARGES. Discharges under the Act were granted as follows : —George Connon, T. W. Mi- Wynn "Williams applied for an order to examine the bankrupt, he having refused to give information to the trustee. His Honor made the order ; examination fixed for January 4th. BE PETITION OF THOMAS TAKKER AND ESTATE OE W. I3AILEY. In this case Mr Joynt applied fo" an order making an absolute order of adjudication, the bankrupt to surrender on Tuesday, 18th, at 11 a.m. GOODS OF ALEX. LEITIT GORDON, DECEASED, INTESTATE. Mr Joynt applied for an order issuing letters of administration to Adam Gordon, brother of deceased. His Honor pointed out that there was no affidavit of search for will. Application to stand over. BE JOHN ELVINES, DECEASED, INTESTATE. In this case letters of administration were granted herein to the widow, on the application of Mr Cowlishaw. GOODS OF JANE TABB. Mr Bamford applied herein for letters of administration to the husband of deceased. His Honor made the order. WILL OF F. O. HAMMOND, DECEASED. Mr Thomas applied for j probate to the executor named in the will. His Honor made the order. WILL OF CHARLES JAMES HODGE, DECEASED. Mr Wynn Williams applied, under the Government Insurance Act, 1870, for an order appointing Catherine Elizabeth Hodge, widow of deceased, as trustee of the insurance money 'payable to his wife and children at decease of insured. After some discussion, His Honor made an order appointing the Public Trustee as trustee of the estate failing the procuring of another approved trustee. BE LAND TEANSFEB ACT. In this case Mr George Harper applied for a rule nisi, calling upon the District Land Registrar to attend and show cause why a caveat entered against rural section 29406 should not be removed. His Honor made the order; cause to be shown at banco sitting, on 4th January next. BANCO SITTINGS. His Honor said that in order to prevent applications lapsing he would fix a banco sitting for January 4th. JOINT STOCK COMPANIES' ACT AND " NEW ZEALAND SUN " NEWSPAPER. Mr O'Neill applied for a rule nisi calling upon the "New Zealand Sun " Company to show cause why the register of shareholders in the company should not be rectified by the addition of the name of Thomas Slater Pratt thereto, and why the company should not be called upon to pay all costs and damages. The affidavits set out that the petitioner, Thomas Slater Pratt, had disposed of the interest of himself, Feilding and Hannah in the " Licensed Victuallers' Gazette" to the company in consideration of the issue to them of thirty shares in the "Sun" Company ; that the number coming to the said petitioner, Pratt, was eight shares, but that the directors had refused to issue the scrip to him, on the ground that the accounts of the "Licensed Victuallers' Gazette " were not such as represented by the petitioner when disposing of his interest. He therefore applied for an order calling upon the company to show cause why his name should not be entered on the shareholders' register, and that they be adjudged to pay to the petitioner a sum of money as compensation for his not being able to dispose of the shares at £lO each, which was the market pi'ice. His Honor said that there was a cause alleged by defendants for the omission of Pratt's name from the register, and he could not take the prima facie denial of Mr O'Neil as a ground for the rule nisi. Ultimately, however, his Honor made the order as prayed for a rule nisi, returnable on January 4th.
