There is some apprehension of a flood tonight, consequent upon the extreme heat yesterday and the rain to-day. , Wellington, December 6. | The Court of Appeal sat this morning. Judgment was delivered in a number of Otago, Southland, and other cases. In the case, Queen against Payne, the Court considered ' the evidence taken below was not admissible, and held that the conviction must be quashed. 1
