IN CHAMBERS. Feidat Novembee 2. [Before his Honor Mr Justice Johnston.] His Honor sat in Chambers at 11 a.m. EE N. P. MEYEBS. On the application of Mr Garrick, His Honor fixed the continuation of the examination of the bankrupt for Monday next. EE ESTATE OP WM. EDWAEDS, DECEASED. Mr Garrick applied for an order empowering Mr R. W. Fereday to convey certain lands devised by the testator, and to act as trustee in so doing. His Honor, after some discussion granted an order appointing Mr R. W. Fereday as the person to carry out the purport of the will and to dispose of the interest of late W. Edwards as devised to his wife. BHODES V BDODKS AND OTHESS. Mr Garrick applied for an order sanctioning the sale of the Seadown estate. Mr Wynn Williams, Mr George Harper, and Mr H. N. Nalder, who appeared for various parties in the suit, consented to the order being made. His Honor made the order as prayed. KEMPTHOENE (APPELLANT) V. LOTJISSON (EESPONDENT.) In this case, which was an appeal from the Resident Magistrate, Christchurch, Mr Garrick, for the respondent, said that his learned friend and himself had agreed to postpone the case. Mr Joynt, for the appellant, applied to have the case remitted again to the Resident Magistrate, in order that the evidence might be taken again. The evidence, unfortunately, had not been taken in writing, and the case had been stated pro forma by the Resident Magistrate. The evidence of the defendant was taken in Dunedin and the plaintiff’s here. The Resident Magistrate here had stated posi tively that he could not recollect the evidence given, and therefore it would be only fair that the case should be remitted to the Resident Magistrate again. After some discussion, His Honor adjourned the case to the next sitting in Banco. DEANSPIELD V. CKEYKE. In this case, which was an application to give security, Mr Joynt asked that it should stand to Tuesday, in consequence of insufficient notice being given to him. His Honor granted the application. MCCONKEY V. STEWAET. In this case, on the application of Mr Harper, an extension of time of pleading for three weeks was granted, conditional on Mr Joynt’s costs of the day being paid. The Court then rose.
