MAGISTRATES’ COURTS.
CHRISTOHURCH. Monday, August 20. (Before Caleb Whitefoord, Esq., R.M., and J. T. Brown, Esq., J.P.) Drunk and Disorderly. —A first offender was discharged with a caution. Dominick Mullaly, for being drunk and resisting the police, was fined 40s. Daniel O’Brien, for drunkenness, was fiued 10s. Arthur McMahon, for drunkenness and obstructing the police, was fined 20s, and Thomas Hallswell in a similar amount. False Pretences. —Mathew Hayes, who had been arrested at Dunedin, was brought up charged with obtaining money by false pretences from Mr Jacob Wagner, of the Clarendon Hotel. The prosecutor stated that early in July last accused came to his hotel, and on the 16th of that month an account for £2 2s was rendered to him. He then drew up a cheque on Wellington for £2 12s in payment and received 10s silver in change. On being presented at the Bank there the cheque was returned dishonored. Inspector Feast asked for a remand to allow of witnesses coming down from Wellington. The Bench remanded accused until 27th instant, to be brought up sooner should the witnesses arrive. In reply to accused, his Worhip said he would grant bail in two sureties of £SO, or one in £IOO. Miscellaneous Offences. —James Mole, summoned for driving two cows along Montreal street during prohibited hours, was fined 10s ; Joseph Fisher, for not being in sufficient attendance on his horse and cart, was fined 10s; George Osborn, for a similar offence, was fined 10s ; for not having a light on a hoarding in Hereford street, Thomas Gee was fined 10s; Thomas Wheeler, for being absent from his horse and cab, was fined 10s ; Patrick Howard, for obstructing the street with his cab, was fined 10s. Houses and Cattle at Large. —-For permitting horses and cattle to -wander at large the following persons were each fined 5s ;—Wiliam Vincent, James Hampton, John Judge, and Francis Le Breton. Unregistered Dogs. —The following persons wore each fined 20s for being owners of unregistered dogs for the current year: Rober Harper, William English, and John Mcllroy. Cruelty to a Horse. —James Pettet was charged with this offence. Sergeant Beck stated that on the 10th of August ho saw defendant draw his horse off the stand at Cathedral Square, and cut him over the head violently with a whip. Mr Garrick called, stated that on that date he saw defendant’s horse come off the stand, when he hit him
violently three or four times over the head with the''butt end 0 f }l whip. His conduct was mostffirutal. Defendant, in excuse, said the horse wanted to go home. His Worship said lie didn’t wonder at it for a moment, and imposed a fine of 20s. Abusive.Language.—Mrs Lynch was summoned for using abusive language towards Mary McPhcc on 10th August. The parties had been neighbours, and the evidence showed that defendant had used very unneighbourly language. Fined 10s. Protection Order.—Mrs Mary Ann Cant applied for an order for the protection of her earnings, and also for the maintenance of herself and two children. Mr Joynt appeared for the complainant. This case had arisen out of one heard a week previously, when defendant had been bound over to keep the peace for twelve months. Evidence was called to show that for some time past Cant had been in the habit of ill-treating his wife, and she had been compelled to leave him on several occasions for her own safety. A married daughter of the parties called corroborated this evidence. Mr Joynt also applied for his client to be allowed the custody of the children. As the eldest was a boy seventeen years of age, his Worship granted complainant the custody of the youngest child, and an order protecting her earnings. Defendant was also ordered to pay 15s towards the support of his wife, together with costs and professional fee. LYTTELTON. (Before W. Donald, Esq., E.M.) Monday, August 20. Drunkenness. - Richard King, arrested by Constable Bulleii, was fined 10s.
