SUPREME COURT.
Sittings at nisi prius. Fkiday, July 20. [Before his Honor Mr Justiee Williams.] The civil sittings of the Supreme Court opened at 10 a.m. GEE V MOORE. This was an action in which Thomas James Gee, of Christchurch, builder, was plaintiff, and G-. H. Moore, of G-lenmark, defendant. It was brought to recover the sum of £309 5s lUd, being the balance due to the plaintiff by the defendant on account of the erection by the plaintiff for the defendant of a manager's hoxtso at Qlcnmark. The defendant paid into Court the sum of £7B 6s 4.Vd, in full of all demands, contending that the extra amount claimed was outside the contract, and had not been passed by the architect of the defendant.
Mr Joynt appeared for the plaintiff. Mr G-arrick for the defendant.
Mr Macpherson was chosen foreman of the special jury. Mr Joynt having opened the case for the plaintiff "by reading the declaration, &c, proceeded to call evidence in support of his case.
The evidence, which was very voluminous, was mainly of a technical, character as to lh» quantity of the work. The material, evidence of the plaintiff as to the performance of ihp work, for the cost of which action was now brought, went to shew that it was done outr side the contract, and in accordance with verbal orders given by the defendant to the plaintiff, irrespective of the specifications and contract under which the house was originally built.
The case was proceeding when wo went to press.
