RE ROBERT MANIE, DECEASED, Mr Harper applied for an order for leave to issue probate to Susau Manic, as sole executrix. His Honor made the order as prayed. REGULATION OF LOCAL ELECTIONS ACT, AND RB THE ELECTION FOR THE RIDING OP MARSDEN, COUNTY OP GREY. Mr George Harper, on behalf of A. B. Guinness, applied, under section 48 of the Regulation of Local Elections Act, 1876, for a rule nisi directed to W. H. Revell, Resident ■Magistrate at Greymouth, calling oa him to show cause why a writ ot prohibition, prohibiting him from proceeding with the petition under the above Act, should not issue, on the following grounds That there is no Resident Magistrate’s Court within the said Riding of Marsden. That the Resident Magistrate’s Court at Greymouth, where the petition under the 48th section of the Act was filed, is not within the county of Grey. That there are several Resident agistrate’s Courts within the said county of Qi That the nearest Resident Magistrate’s Court to the riding of Marsden aforesaid is the Resident Magistrate’s Court at Cobdon, in the said county of Grey. And on the further grounds stated in the affidavit of A. R. Guinness, His Honor—That is a prima facie case. Take yonr rule. Rule nisi granted, returnable on Tuesday, February 6th, or as soon after as may be convenient, his Honor remarking that some public wrong might ensue if the argument were postponed until after Vacation. The Court then rose.
