An ex-patient of the Lunatic Asylum, named Burns, seeks to recover £IOO damages from Superintendent Hume for assaults. The plaintiff, in his evidence, said defendant handcuffed him, f astened his arms behind his back, and then put him into a ward. As the irons were not loosened he had to lie on his face. The on iy covering on the bed was a piece of canvas. In the afternoon when he asked to be released defendant said, “ You must grin and bear it.” On an interruption by his counsel plaintiff said “ 1 told you of the ac Hons ; you are not examining mo upon them It ooks as though you wished them passed ov*r instead of properly bringing the case before rhe puolic.” He then went or to say the handcuffs were taken off on the Sunday following, The doses of physic given him were enough to kill a norse. Ho complains that :ie was put in a cell for forty-eight hours ; th re stripped almost naked, and subjected to other ill-treatments. Many of his answers in the box warrant a belief that he is still suffering from hallucinations. Hume’s counsel said his client courted the fullest enquiry, and would show that the plaintiff is still insane and unfit to be at large, his statements being unfounded. Dr Hume said plaintiff when in the asylum was very anxious to be released. Eventually he was released in the hope that a change would do him good. He was on one occasion put in a cell for striking a warder. Plaintiff was handcuffed, but not strapped. The case was adjourned for a week at this stage. The City Council intend appointing a city treasurer at £4OO a year.
