August 29—Taupo, s.s, 462 tons, Worsp, from Port Chalmers. Passengers—Saloon : Mrs Morsong and family, Misses Montague and Hoyt, Messrs Hodge, Hoyte, Sheen, Booth, Hoskins, Hallenstein, McNae; 12 in steerage, and 25 for North. August 29—Jane, brig, 160 tons, J. Delmar, from Hobart Town. August 29—Antelope, cutter, 17 tons, Malcolmson, from Akaroa. August 29—Flirt, brigantine, 100 tons, McKensde, from Auckland. CLEARED. August 29—J. G. Coleson, brigantine, 70 tons, Brown, for Wanganui. August 29—Torea, schooner, 78 tons, Grundy, for Kaipara. August 29-Quiver, ketch, 19 tons, Smith, for Le Bon's Bay. August 29—Taupo, s.s, 461 tons, Worsp, for Northern Ports. SAILED. August 29—Omaha, brigantine, 132 tons, Meiklejohn, for Auckland. August 29—Island City, barque 421 tons, Linklater, for Sydney. The vessels that have been detained sailed last night when the sou'-westei sprang up. The Taupo from Port Chalmers arrived in harbor at 7.10 a. mth's morning. She sails North this afternoon. The Jane, brig, from Hobart Town, and Flirt, schooner, from Auckland, arrived this morning.
THE LOSS OF THE ANN. The following decision of the Gonrt on the collision between the barque Australian Sovereign and Ann has been delivered:—That the loss or damage appears, by the evidence, to have been caused, or occurred under the following circumstances:—That a collision between the vessels Australian Sovereign and Ann occured in consequence of a sudden shift of wind, as it appears that when, and while, the former vessel, which was overtaking the latter, was maneuvering to keep elear of her, and which manoeuvre was at the instance and by and under the direction of Thomas Henderson, chief officer of the Australian Sovereign, who was in charge of the deck at the time. That the Ann—which vessel is said to have been built of ■oft wood, and to be of considerable age—does not appear to have sustained any very material damage —the exclamation of one individual aboard of the Ann, "We are sinking," being probably more the effect of panic, rather than from any actual knowledge of imminent danger. That tbe Ann was afterwards lost upon a spit while endeavoring to reach the harbor of Port Stephens, but no evidence is obtainable as to ber condition at that time. That Isaac Benjamin Burch, the master of the Australian Sovereign, was justified in proceeding on his voyage when those in charge of the Ann made no endeavour to communicate to him the condition of that vessel, when, had that condition been a critical one, they might have been expected to make some effort. lam also of opinion that the conduct of Thomas Henderson, the chief officer of the Australian Sovereign, in not calling the attention of the captain, who was below, to the relative position of the two vessels while at a safe distance, was injudicious, as he thus excluded himself from having the benefit of his master's judgment and experience, which it is but reasonable to suppose might have been serviceable in endeavoring to guard against a contingency, viz, the shift of wind and consequent collision which subsequently happened.
