SITTINGS IN BANCO. Tuesday, April 25. (Before His Honor Mr Justice Johnston,) RE J. R. MARTIN, A BANKRUPT. Mr Joynt brought under the notice of his Honor the order made herein, by which the bankrupt’s pension for a certain number of years was made liable to his creditors until 10s in the £ of his debts had been paid. His Honor made an order enjoining the bankrupt to do all things necessary to enable the creditors to receive half his pension for five years. RE RICHARD AND JOSEPH BROWN. In this case a rule nisi had been obtained by Mr Garrick, for Mr Richard Walton, trustee in this estate, calling on Messrs John Connal, John Aitken, and Henry Hayes Hennah to show cause why they should not be arrested under a writ of attachment for that, they having been duly summoned to attend before Richard Walton, as trustee in the estate of the bankrupts, under the Debtors and Creditors Act, there and then declined to answer questions put to them regarding the affairs of the debtor. Mr Joynt now appeared to shew cause. Mr Garrick appeared in support of the rule. Mr Joynt having addressed the Court, His Honor said that, though the 31st section did not provide what was to be done in case witnesses refused to answer, the intention of the Legislature was so apparent, that he felt bound to decide against Mr Joynt without calling on Mr Garrick to reply. Order made ; rule absolute, with costa ; warrant to lie in the office for fourteen days, the witnesses undertaking to attend the trustee within that time.
