CHRISTCHURCH. Tuesday, March 21. (Before G. L. Meliish, Esq, B. M.) Drunkenness —The following ihebriates were dealt with George Snedd, who was also charged with creating a disturbance in Cashel street, was fined 10s. Mary Gordon was fined as a frequent offender 20s and Is cab hire. Daniel Janies Reary was fined ss. Civil Cases. —Beatty v Wilson. In this case G. W. Beatty, of the Q O.E. Hotel, is plaintiff, and John Wilson, of the Palace Circus, the defendant. The action was brought to recover the sum of £8 10s, for board and lodging, as per agreement. Mr Duncan for plaintiff ; Mr Jameson for defendant. The plaintiff deposed that previous to the circus coming here, Mr Dodge, defendant’s general agent, engaged board and lodging in defendant’s house for seven of the company. Witness told Dodge that the terms would be 30s a week for each, but subsequently, at Dodge’s request, he reduced the terms 6s a week each. Finding the parties did not come, he waited on Mr Wilson, who was very abusive, and witness told him he should take other steps to recover the money. Witness kept the rooms empty for a week, and then he waited on Wilson on his return from Timaru, and finding him abusive, and that he would not pay, witness took out a summons. Witness let the rooms to Dodge as Wilson’s agent. In conjunction with Mr Baylee, ; witness let a paddock to Dodge for Wilson’s circus, and they had to seize the goods on the ground for the rent. John Baylee, of the Criterion Hotel, stated that Dodge had taken rooms on similar conditions in his house ; the performers occupied them and paid for them. The agreement was made with Dodge 'in Wilson’s name, For the defence, W. F. Warner, proprietor of Warner’s Commercial Hotel, was called, and said that Wilson and others boarded and lodged at bis hotel. Wilson said that he was not responsible for his troupe, but only for himself, Kingsley, and Thomson ; Wilson paid for these and the others paid for themselves. Dodge came before the circus arrived and engaged apartments for sixteen, saying that he paid for Wilson, Kingsley, and Thomson only, the rest must pay for themselves. Mr Duncan addressed the Bench, pointing out that Wilson was bound by the act of his agent Dodge, who it was singular had not been examined in Dunedin on the part of the defendant. The question was, did Dodge act as agent for Wilson, and did Beatty keep these rooms in pursuance of the engagement made with Dodge on Wilson’s behalf. Mr Jameson, for defendant, contended that the whole intention of the agency was to take a paddock, &c, and not to engage rooms fo? the company. The evidence of Wilson had been taken in Dunedin, and he denied having given Dodge authority to take the rooms. His Worship said it was somewhat singular Dodge’s evidence had not been taken. Here was Dodge acting as Wilson’s agent, and it was on the faith of that the plaintiff had let the rooms. Judgment for plaintiff for £8 10a and full costs. Immediate execution granted. LYTTELTON. Monday, March 20. (Before W. Donald, Esq, R.M.) Drunk and Disorderly. —Joseph Marks, irrested by Constable Moutray, was fined i 0 or in default 48 hours. Damage to Ship and Embezzlement op Cargo. —John Barlewis, and Samuel Stevens, seamen, belonging to the ship Rangitikei, were charged with the above offence by Captain Scotland. Mr H. N. Nalder appeared on behalf of the captain, and withdrew the charge against Samuel Stevens. After hearing evidence the case was remanded till this day.
