MAGISTRATES’ COURTS.
CHRISTCHURCH. Wednesday, March 1. (Before G. L. Meliish, Esq, R. M.)
Drunkenness. —The following cases were dealt with :—William Atwood was fined 10s ; Theresa Dixon, case dismissed, as the woman was in the Hospital with a broken leg ; Ellen Jordan, who was also charged with assaulting the police, and who only came out of gaol yesterday, received a sentence of one month’s imprisonment with hard labour ; John Cunningham was fined 10s.
Civil Case—Dowdle v. Avon Road Board.— His Worship gave judgment in this case for the plaintiff, remarking that although the plaintiff was entitled to damages he thought those damages should be merely nominal. It was no doubt the duty of the Road Board when they dealt with the water to have conducted it right off the plaintiff’s land, and it was a pity they had not done so. Judgment would be for the plaintiff with. Is damages. Mr G. Harper applied for costs, remarking that the action had only been brought to try a right. His Worship allowed costs £lO 11s. Mr Cowlishaw gave notice of appeal.
