BREACH OF PROMISE OF MARRIAGE CASE.

An action for breach of promise of marriage was raised lately in the Sheriff Court, Linlithgow, at the instance of Mary Cairns, domestic servant, Haddington, against Thomas Morris, minner, Armadale, near Bathgate. The pursuer is described as a pretty girl of about nineteen, and the defender is to appearance about twenty-six years of age. They became acquinted in August, 1873, in the house of the pursuer’s sister, in Armidale. About ten days after their introduction to one another, Morris wrote to the pursuer at Stonehouse, where she then resided, stating that if she was not already engaged he would take her for his wife, and make her “ as happy as a queen.” She was no,t tardy in sending answer accepting of his office, and a loving correspondence followed. In one of his epistles, dated 7th October, ho declared that “if God spared them they would be as happy as a king and queen and in a later one, asking her advice as to some of the wedding arrangements, he concluded by saying, ‘ ‘ we will both be as happy as the day is long.” It was finally arranged that the marriage should take place on the last day of December, but about Martinmas, when the girl visited Marmadale, at Morris’ request, to’ make preparations for the ‘ ■ happy” future, she found her lover had gone to Fife, and after his return he entirely ceased to meet or correspond with her. The action concluded for £SO damages. Before the case came to proof the parties compromised it, and the Sheriff has decerned for the expenses incurred to. the pursuer therein.
