[Before G. L, Hellish, Esq, R.M.] Drunkenness. —Edward Brown, fined 10s and Is cab hire, and cautioned not to appear again ; Edward King, fined 20s ; Janies Bettington, a labouring man, was fined 5s ; Jno Hammond, who was also charged -with using obscene language, was fined 20s. Affiliation. —Peter Dunn appeared to show cause why he should not contribute to the support of the illegitimate child of Catherine Pollock, of which he was alleged to be the father. Mr O’Xeil appeared for defendant. After hearing the evidence his Worship made an order on defendant to pay 7s 6d per week into the Court towards tho support of the child, with costs 9s; the order to date from May 14th last Illegally Pawning. —John Armfield appeared on remand charged with illegally pawning a watch, the property of David Stott. The following additional evidence was taken:—The prosecutor stated that the watch produced was his property, which he had recently sent to Christchurch. Prisoner had no authority to dispose of it in any way. Detective Feast deposed that he found the pawn ticket produced in a bundle of papers belonging to prisoner. Henry Alexander, assistant to Samuel Stewart, pawnbroker, Lichfield street, identified the ticket produced, which related to a gun pledged by a man named Goodacre, for £2 10s, on 4th May, Edward Goodacre proved the pledging of a double-bar-relled gun for prisoner at Stewart’s. The owner of the gun said that prisoner received the gun from him as collateral security for a pound. Prisoner had no authority to pawn the gun, which was worth £lO. The prisoner said he did not wish to put the Bench to any further trouble. He 'owned that he pawned the gun. The prisoner was committed for trial on both charges at the next sittings of the Supreme Court. Adjourned Licenses. —The adjourned applications for public-house licenses were further adjourned for a fortnight.
Provoking a Breach of the Peace.— Daniel Howard, a cabman, was charged on information with behaving to Benjamin Ward so as to incite him to commit a breach of the peace. The complainant also sued defendant for £5 damages for an assault. Dr Foster appeared for complainant, and Mr J. B. Gi reason for defendant. It appealed that defendant was engaged by complainant to drive him home on 22nd ult. Complainant offered defendant his fare, 2s, which he refused to take, saying—“ You —, I’ll punch it out of you.” Complainant said —“ My name is Ward; you know where I live; you can summon me if srou5 r ou like.” Defendant then took complainant’s hat, and drove away with it. Two days afterwards defendant offered to return the hat, saying he was sorry, and wanted complainant not to bring the case forward. This took place at half-past nine o’clock in the evening. Defendant, on being examined, said that complainant took off his hat, saying, “You take that hat if you think 1 have not paid you enough ; you cabbies are a low lot of fellows, I know you well.” Defendant at last took the hat. Complainant spoke in a thick tone of voice, and tumbled down. It was a quarter past 10 o’clock at night, and witness was entitled to charge half fare extra. Mr, Gresson said
that there could hardly be an assault, as there was no intention to inflict corporal injury (Roscoc’s Nisi Prius . p. (Jl3), Complainant could not claim damages for the hat, as the defendant had offered to return it, but complainant refused to take it back. His Worship said that there was no doubt Howard had behaved very injudiciously. If he thought himself wronged he should have summoned complainant. He (defendant) would be fined 10s, and in the civil case ordered defendant to return the hat, with costs 9s, and professional fee £1 Is.
