Accused was locked up in default. LABCRNY. David and Thomas Evans were charged, on remand, with stealing' brand;. Evidence was called to show that thirty cases of brandy were, delivered at the creek by the Clyde, and stacked near the house at 6 o'clock in the evening, and pot in the store in the morning; when one case was missing. The accused were at the hotel that afternoon. Nine bottles of brandy were found on'the opposite side of the creek to where the steamer was lying. Mr Nalder addressed the Court, contending that there was nothing to connect Tbos. Evans with the matter. : • -s The Bench asked the prisoner David Evans if he had anything to say for himself.

David Evans said—As I was coming aboard the vessel a man came op to me and clapped the box on my shoulder. I thought it. was luggage. I took it on board. It was nearly twelve. I managed to get it aboard, and the side came out, and I fouud it was brandy. I put three bottles in a bunk. Thomas Evans was asleep. I opened one of the bottles, and gave the other accused, Thomas Evans, a drink, and on being asked by him where I got tire bottle 1 declined to say, The Bench said they would give Thomas ‘ Evans the benefit of the doubt, but at the same time a great deal of pillage was going on, which must be checked. The account given by David Evans was most improbable, and no doubt he stole the brandy. He discharged Thomas Evans, and sentenced David Evans to six months’ imprisonment with hard labor.
