MAGISTRATES’ COURTS.
CHRISTCHURCH. Wednesday, November 25. (Before C. 0. Bowen, Esq, R.M.) DRUNK AND DISORDERLY. Hugh Donnelly, arrested for being drunk and destroying Government property, was fined £l. LYTTELTON. Tuesday, November 24, [Before W, Donald, Esq, R.M.] BREACH OF PUBLIC HOUSE ORDINANCE. William Burnip was charged upon the information of Sergeant Maguire with the above offence. Mr H. N. Nalder appeared for the defence. The constable stated that upon Sunday, 15th November, he saw several people enter the house of the defendant. Upon his going in he saw the bar open, and the barman behind the bar serving out drinks. He saw drinks in the hands of Mr Offwood of Christchurch, and Mr G. Walker, of Lyttelton, Mr G. Walker was the next witness called, but totally denied having a drink at all. The barman also denied serving a drink to Walker. Sergeant-Major O’Grady here applied for a remand until Thursday nest for the production of further evidence, which was granted. Stephen Bailey was charged by Sergeant Maguire with a similar offence. Mr Nalder appeared for the defendant. The sergeant stated that on Sunday about nine o’clock a.m. he saw the door of the defendant’s licensed house open, and upon going in found Mr Bailey behind the bar, with Mr Burnip and two others drinking at the bar. Mr Burnip called, stated that he was taking a walk on the morning in question, when Mr Bailey called him in to have a drink, which he had, but no money was passed. He wanted to pay for the drinks, but Mr Bailey would not allow him. Mr Nalder contended that the Act had not been infringed in any way. The Resident Magistrate, in dismissing the information, said he thought there had been a breach of the Act, but it was technical. BREACH OF STAMP DUTIES ACT. Charles Frauckot was charged upon the information of Sergeant Major O’Grady with the above offence, and fined 5s and costs. BREACH OF WATERMAN’S REGULATIONS, George Deans, licensed waterman of Purau, was charged by Mr F. Foster, with refusing to employ his boat when required by Mr Foster without giving reasonable excuse. Mr Nalder appeared for the defendant, and the Bench, after hearing the evidence, fined defendant 2s 6d and costs. CIVIL CASE. Hawkins v Leith, master of Especulador, cla m £7 Os 6d, for goods supplied to the ship; judgment for amount claimed and costs.
