SUPREME COURT.
SITTINGS AT NISI PRIDS. Saturday, August 1. [Before his Honor Mr Justice Gresson and a Special Jury.] The Court reopened at 10 a.m. DRURY V. PAIN. The hearing of this case was resumed. John Thomas Pain, the defendant, was cross-examined by Mr Cowlishaw at some length, principally with respect to the medicine supplied to his son by plaintiff, and the symptoms of his illness. Richard Wills was the next witness, and gave evidence as to Dr Drury administering an emetic to defendant's son on August 9th—the commencement of the illness —and that he heard the doctor tell him he had a severe attack of bilious fever.
James Thomas' Pain, son of defendant, gave evidence as to the effect of the emetic administered to his brother on the 9th of August. On the day previous to the death of his brother, the plaintiff gave orders for the fire to be put out, and the doors and windows opened ; but they did not follow his instructions to the letter, as he was intoxicated. This witness was also examined and crossexamined respecting the treatment of the deceased by the plaintiff. Mrs Pain also gave evidence at great length on the same subject. The Court then adjourned till 11 a.m. this day.
