THE INSPECTION QUESTION

The hearing was continued to-'d'a.v before the Kail Court of the appeal by Alexander, Penman (miiiei manager for the Taupiri Collieries Co.. Ltd.), for having failed to have parts of Ralph’s mine at bluntly inspected daily, and. that he, in consequence, failed to see that the working of the- mi no was carried on with all reasonable - provisions for the safety of the persons employed therein. Continuing his argument lor the Grown, the Solicitor-General contended that it was the duty of the company to see that the working face was free* from noxious gases, and that could only he done by an examination of the old workings as well, as of the working face. If the old workings had: to he examined under that assumption, then the terms of the Act applied and they must be examined daily. Mr. C. P. Skerrntt, K.C., in replying, said a position might arise as to the responsibility of the manager as apart from the under viewer,- hut he would not touch on that at this stage. The rule regarding daily examination had, been in existence since 1891, and never before had it been suggested that -it applied to old and) disused workings. The Court reserved its decision. .
