CERTIFICATE RETURNED ON APPEAL. [Press Association.] AVELLINGTON,. Dec. 17. Mr. Justice Cooper and Captains McArthur and Post, .assessors, had before them in the Supreme pourt today an appeal by Frederick Gamble, second officer of the Penguin, against the suspension of his certificate by the Magisterial Court that enquired intothe Penguin-Gertie collision, on the ground that the Shipping and Seamen’s Act requires that before a certificate can be suspended there must have been serious damage to the ship through the act of defendant or a person holding a certificate. The .Court found that serious damage had not been sustained, and upheld the appeal, and awarded appellant £5 os costs.
