TUESDAY, OCTOBER 6. (Before Mr. AV. A. Barton, S.M.) DRUNKENNESS. Two first offenders were convicted and fined 5s and 2scosts, or in default 24 hours’ imprisonment. James Tait, for a fourth conviction of drunkenness within 2 months, was sentenced to two months’ imprisonment with hard labor in the Napier gaol. Alex. A\ 7 ilson pleaded guilty to three previous convictions within six months, but stated .that he had just conic out of the hospital, and had a couple of drinks, which knocked him over.

Sergt. Hutton stated that the mail had just come out of the hospital, and was a hard-working, quiet man when not in drink.

His "Worship said lie had no desire to send the accused to prison , and would try another plan. He would bind him over in his recognisance to come up for sentence when called upon. Alfred Wilson pleaded not guilty to a charge of having been, found drunk in Lowo Street on the previous evenr ing. Sergt. Hutton gave evidence of the arrest of the accused, who was leaning against a wall incapable of ingAccused strenuously denied having been drunk, stating that- he suffered from beat apoplexy. He became quite ■excited wlion cross-examining the sergeant regarding a constable having struck him, and His Worship ordered the case to stand over until 2 o’clock for additional evidence. Wlion the cise~was called on in tho afternoon the accused did not put in an appearance, and after hearing the evidenco of Constable Anderson, His Worship ordered that the amount of -accused’s bail, £l, should lie forfeited, remarking that the behavior of the man was certainly strange and that ho (His Worship) had no doubt the man was drunk. PROCURING LIQUOR.

James T-ait was also convicted of having procured liquor while under prohibition, and was fined £5 with 5s costs, or 30 days’ imprisonment, the sentence to bo concurrent with that imposed for drunkenness. John Green and Albert Nicholson also pleaded guilty to a similar charge and were each convicted and fined £o with 7 s costs, in default 30 days imprisonment in the Gisborne Police oa ° L SUNDAY TRADING. C. Clmstopulo pleaded guilty to a charge of having sold 3d worth of lollies to Constable Scott, on September 27. » Sergt. Hutton said that; many complaints liad been made regarding Sunday trading, and defendant pleaded that he saw all the other shopkeepers doing the same tiling. His'Worship remarked that it was the first case of the kind that had come before him, and imposed a penalty of 10s and costs 7s, .with' a promise to increase the amount for any further infringement.
