A BANKRUPTCY CLAIM.
A TIMBER CONTRACT. Evidence in a long-standing case was finally taken yesterday before Mr \V. A. Barton, iS.M., alien file Alpha Sawmill Timber Co. (Mr. Stock) pro/•eded against the Official Assignee in tlio ornate of Win. Cruinji, and Messrs Hamon and Smith (Mr. R. U. Burke), to recover flip amount oi £2OO for material supplied. Evidence taken, in Oargavdlo in .connection with tlio case was roau and Mr. Stock proved service of notice on tlio defendants by liis clerk. Thos. M. Collins, manager of the Alpha Sawmills, know of the contractmade with Crump for the supply of timber for Attwood’s boarding-house. Tlio price of the timber was to he at ruling rates. Crump /was supplied with all the timber mentioned in the claim. AVliile this was going on there was *ll rise in timber, hut the original prices as agreed were adhered to. Crump was also getting timber for other jobs, for which ho had to pay the increased rates. The . items for joinery were all ordered at one time, the last item being supplied when the job was finished.
William Crump gave evidence of the agreement with tlio plaintiffs for the supply of timber for Attwood’s job. The prices fixed wore the ruling prices, which were charged right through. All the timber obtained for the contract was used in the contract. For other timber he had to pay higher rates. The certificate of the corporation of the company having been produced, Mr. Stock said that lie considered the cage was conclusively proved. His Worship held that the claim •had been- proved, and gave judgment accordingly.
